5. Eligibility
To use the Site and to submit information through the forms, you declare and warrant that:
- You have full legal capacity (you are of age under Romanian law — at least 18 years old — and you are not placed under legal interdiction);
- You have the legal authority required to accept these Terms, either in your own name or on behalf of the legal entity you represent;
- The data you provide is true, accurate, complete, and up to date;
- You do not use the Site for unlawful, fraudulent, or otherwise prohibited purposes under these Terms.
For applications to open positions (/careers), a minimum age of 18 years is mandatory.
6. User conduct
6.1. You have the right to:
- Freely visit and browse the Site for personal or professional purposes;
- Send legitimate requests and messages through the available forms;
- Access the legal documents and public information about Mitzuu Media.
6.2. You undertake not to:
- Use the Site to transmit unlawful, misleading, defamatory, obscene, offensive, discriminatory content, or content that infringes the rights of others;
- Submit false, fraudulent, repetitive, or abusive requests through the forms;
- Use the Site to distribute malware, viruses, trojans, or any other harmful code;
- Attempt to gain unauthorized access to the Site's systems, servers, or databases (including through automated mass scraping, brute-force attacks, or vulnerability exploits);
- Overload the Site's infrastructure through DDoS attacks or excessive automated requests;
- Reproduce, copy, distribute, sell, or commercially exploit the Site's content without the prior written consent of the Operator;
- Use the MITZUU trademark, logos, channel names, or the likeness of associated persons in a way that could mislead the public;
- Use the Site for unfair competitive purposes, such as collecting information in order to offer similar services on your own behalf.
Breach of any of the obligations above may give rise, as the case may be, to the civil, administrative, or criminal liability of the User, in accordance with Romanian law.
7. Intellectual property
7.1. Our rights
All intellectual property rights in the Site and its Content — including, but not limited to: design, structure, source code, texts, images, videos, animations, graphics, logos, databases, and visual arrangements — belong to MITZUU MEDIA S.R.L. or its licensors and are protected by:
- Law no. 8/1996 on copyright and related rights;
- Law no. 84/1998 on trademarks and geographical indications;
- Applicable international treaties (Berne Convention, TRIPS, WIPO).
7.2. Registered trademarks
The following trademarks are registered with OSIM (the Romanian State Office for Inventions and Trademarks):
- MITZUU
- TRY AC (TRY Academy)
- TRYHAR (Tryhard)
The use of these trademarks, in any form (verbal, figurative, partial, or altered), is permitted only with the prior written consent of the rightholder. Unauthorized use constitutes counterfeiting and may give rise to civil and criminal liability under the law.
7.3. Content on YouTube channels and social media
The videos, photographs, thumbnails, and descriptions published on the YouTube, Instagram, and TikTok channels and on other platforms operated by Mitzuu Media are protected by copyright. Their use, redistribution, reproduction, or processing for purposes other than those permitted under copyright law (e.g., news reporting, short quotation with source attribution) requires prior written consent.
7.4. User-submitted materials
When you submit User Materials through the forms (e.g., links to a personal portfolio, project descriptions, campaign proposals), you warrant that you hold all rights to those materials and you grant the Operator a non-exclusive, royalty-free, worldwide, and revocable license to use them solely for the purpose of evaluating your request. This license automatically terminates upon completion of the evaluation or upon your express request for deletion.
8. Forms and interactions
8.1. The contact form
Allows general communication to be sent to the Operator. The reply is not contractual in nature and does not constitute a binding offer unless this is expressly stated in the communication.
8.2. The brands form (partnership proposals)
This is a channel for initiating pre-contractual discussions. Submitting the form does not constitute a contract and does not require the Operator to accept or respond favorably to a proposal. Any partnership will be formalized exclusively through a separate written contract signed by both parties, which will prevail over the content of this page.
8.3. The careers application form
Allows candidates to submit applications for open positions. The Operator is not required to reply to every application and reserves the right to select candidates solely on professional criteria, in compliance with the principle of non-discrimination. The recruitment process does not, in itself, give rise to an employment relationship — any hiring will subsequently be completed through a separate individual employment contract or a separate services agreement.
8.4. Anti-spam mechanism
All forms are protected by Cloudflare Turnstile and a honeypot field. Submissions identified as spam, abusive, or automated will be rejected without notice, and the IP addresses involved may be blocked on a temporary or permanent basis.
9. External links
The Site contains links to third-party resources (YouTube channels, Instagram profiles, TikTok, Instagram posts, YouTube videos featuring brand campaigns, etc.). These links are provided solely for the User's convenience. The Operator does not control the content, privacy practices, or policies of these third-party sites and accepts no liability for them. Accessing these links is done at the User's own risk, and users are encouraged to consult the terms and policies of the respective platforms.
10. Limitation of liability
The Site and the Content are provided “as is” and “as available”, without express or implied warranties. To the extent permitted by Romanian law, Mitzuu Media S.R.L. does not warrant that:
- The Site will operate uninterrupted or error-free;
- All errors will be remedied within a specific timeframe;
- The Content is accurate, complete, or continually up to date;
- The Site is free of viruses or other harmful components.
The Operator will not be liable for:
- Indirect, incidental, special, punitive, or any other damages arising from the use of or inability to use the Site (loss of profit, loss of data, business interruption, loss of reputation);
- Damages caused by errors, omissions, interruptions, deletions, defects, delays in operation or transmission, computer viruses, or communication line failures;
- The content, policies, or actions of third-party sites accessed through links;
- The acts or omissions of Users or third parties.
The Operator's total liability to the User, regardless of the nature of the claim, is limited to the amount actually paid by the User (which, for the use of the Site as such, is zero). Nothing in these Terms excludes or limits the Operator's liability in cases mandatorily provided for by Romanian law (wilful misconduct, gross negligence, bodily injury).
11. Force majeure
The Operator will not be liable for the non-performance or delayed performance of its contractual obligations if this is due to an event of force majeure or fortuitous event, as defined in art. 1351 of the Civil Code. Force majeure events include, without limitation: natural disasters, wars, riots, large-scale cyber attacks, prolonged outages of telecommunications or electricity infrastructure, orders of public authorities, and pandemics.
12. Confidentiality and personal data
The way in which we collect, process, and protect your personal data is detailed in the Privacy Policy, which forms an integral part of these Terms. Please read it carefully before submitting any data through the Site.
13. Changes to the terms
The Operator reserves the right to modify these Terms of Service at any time. The version in force is always the one published on this page, with the date of the most recent update shown in the header.
Continued use of the Site after the changes are published constitutes tacit acceptance of the new Terms. For material changes, we will display a visible notice on the Site or notify you by email (if we have an address for you) at least 15 days before the changes take effect.
14. Dispute resolution
The parties will make every effort to amicably resolve any disagreement arising in connection with the use of the Site. We encourage you to contact us first at contact@mitzuu.ro and describe the issue clearly.
For consumers (natural persons): you have the right to use alternative dispute resolution mechanisms:
- ANPC — the National Authority for Consumer Protection: anpc.ro
- SAL — Alternative Dispute Resolution: anpc.ro/categorie/1271/
- ODR platform — Online Dispute Resolution (European Commission): ec.europa.eu/consumers/odr
For professionals (B2B): any dispute not settled amicably will be submitted to mediation or directly to the competent courts, as set out in section 15.
15. Governing law and jurisdiction
These Terms of Service, as well as any legal relationship arising between the User and the Operator in connection with the Site, are governed by Romanian law.
Any dispute that cannot be resolved amicably will be submitted to the courts having material and territorial jurisdiction over the Operator's registered office (Sector 2, Bucharest), except in cases where the law mandatorily provides for another jurisdiction (for example, for consumers, the court at the claimant's domicile may be competent).
16. Final provisions
- Entirety: these Terms, together with the Privacy Policy, constitute the entire agreement between the User and the Operator regarding the use of the Site and supersede any prior agreements or understandings on the same subject.
- Severability: if any provision of these Terms is declared null or unenforceable by a competent court, the remaining provisions will remain valid and continue to produce full legal effects.
- Waiver of rights: the Operator's failure to exercise, or delay in exercising, a right does not amount to a waiver of that right.
- Assignment: the Operator may assign all or part of its rights and obligations under these Terms to another entity in the event of a reorganization, merger, or transfer of business, with prior notice to Users.
- Language: the official version of these Terms is the one in the Romanian language. Any translations into other languages are for information purposes only.
